On Friday, November 20, 2020, the Office of the Inspector General (OIG) of the Department of Health and Human Services (HHS) published a final rule entitled “Revisions to the Safe Harbors Under the Anti-Kickback Statute and Civil Monetary Penalty Rules Regarding Beneficiary Inducements.” This rule aims to reduce regulatory barriers to care coordination to facilitate the transition to value-based care. The rule implements seven new safe harbors and modifies four existing safe harbors to protect value-based arrangements and foster better coordinated patient care.
